Pushit Mobile Application Terms & Conditions

1- General
The Pushit Mobile Application Terms and Conditions (“Terms and Conditions”) govern the terms and conditions regarding your use of the Pushit Mobile Application (“Mobile Application”).
Users accept and undertake that they will be subject to these terms and conditions while using the Mobile Application and will act in compliance with them. Otherwise, while our legal rights are reserved, we reserve the right to deactivate or permanently delete your account without any notice. If you do not accept these terms and conditions, you should not access or use the Mobile Application. All responsibility arising from any contrary use belongs to the User.
2- Purpose and Scope
The purpose of these Terms and Conditions is to determine the usage terms and conditions of the Mobile Application, acceptable use, and the rights and obligations of the parties.
It covers all persons (“User”) who download, access, visit, or use the Mobile Application through the Apple Store or Google Play, and benefit from the Mobile Application service within the specified conditions.
3- Subject and Purpose of the Pushit Mobile Application
PushIt allows users to save links/URLs they encounter on websites or other mobile applications, and organize them under categories and tags they define.
Pushit aims to help Users collect links they want to access later in one central place, search among saved links, categorize them, and organize them with tags.
Links (URLs) added to Pushit are determined and saved by the users themselves (you). All responsibility for links determined and saved by the User, as well as categories and tags created, belongs to the User.
When the User clicks on saved links, they are redirected to the relevant third-party platform or application where the content is hosted. Pushit has no control over third-party websites, mobile applications, and other platforms to which User-saved links redirect. Pushit bears no responsibility for the accuracy, currency, security, or legal compliance of third-party websites, applications, or content, and does not make any representation, warranty, or commitment in this regard.
4- Acceptable Use of the Mobile Application and User Obligations
4.1. Compliance with Terms and Conditions, Legislation, and Law
The User is obligated to act in compliance with the terms and conditions, all applicable laws, regulations, legal legislation, ethical principles, and rules of good faith while using the Mobile Application.
The User may not engage in any illegal activity. Saving links with illegal or unlawful content to the Mobile Application is strictly prohibited. The User is responsible for using the Mobile Application in compliance with legislation.
The User accepts, declares, and undertakes that while using the Mobile Application, they are obligated to respect, without limitation, the privacy, personal data protection, intellectual property rights, and all other legal rights of third parties.
Pushit is authorized to disclose data obtained within the scope of the Mobile Application belonging to Users to authorized persons or institutions in order to fulfill its legal obligations in accordance with legislation and at the request of authorized persons or institutions.
4.2. Information Security
The User may not partially or fully copy, reproduce, or reverse engineer the source code of the Mobile Application software, may not interfere with the software code in any way, may not make it available for use by third parties, may not use it for any purpose other than individually benefiting from the Mobile Application within an acceptable framework, and any unauthorized interference, modification, or other uses of the software are prohibited.
The use of the Mobile Application for spam, distribution of illegal content (links redirecting to harmful or illegal content), saving such content, engaging in any action threatening its security, disproportionate loading, engaging in any activity that may prevent or damage the operation of software, and any other malicious use, copying, or reproduction is strictly prohibited. The User is exclusively responsible for any damages arising from any malicious activity threatening information security.
4.3. Account and Password Security
Users can use the Mobile Application by creating an account with an email address or by signing in through Google or the App Store. User accounts, access information, and passwords are specific to the User and should not be shared with third parties.
Strong passwords (containing uppercase and lowercase letters, numbers, special characters, and at least 12 characters in length) should be created by the User.
You should update your passwords at regular intervals.
4.4. Verification
In case the User forgets their password, a password reset request can be made. In this case, verification must be done through the User’s registered email address. After verification, the user can continue using the application by resetting their password.
Pushit may use verification methods such as 2FA.
4.5. Content and Usage Obligations
The User is responsible for all activities arising from links saved to the Mobile Application, categories and tags created, and other usage.
It is prohibited for the User to save unsafe links to the Mobile Application that are illegal, violate the rights of others, or link to harmful content, and to engage in other such operations.
The User is responsible for ensuring that data uploaded to the Mobile Application is accurate and up-to-date.
Pushit bears no responsibility for links saved by the User within the Application, link parameters, categories and tags created by the User, third-party websites to which User-saved links redirect, or content on linked websites/applications.
Regarding links determined and saved by the User within the Mobile Application, the sole addressee for applications by third parties, rights holders, or authorized persons or institutions is the User. In case of detection of any illegal or inappropriate use or violation of third-party rights, necessary measures will be taken and the User account will be closed by Pushit without assuming any responsibility.
4.6. Protection of Personal Data and Privacy
Pushit respects the privacy of Users’ data.
Pushit fulfills its obligation to inform within the scope of the User Information Notice.
Pushit does not collect or process unnecessary data from the User within the framework of the data minimization principle and acts in compliance with the principle of proportionality.
Pushit, in terms of providing the Mobile Application, and the User, in terms of activities arising from use, will act in compliance with personal data protection legislation and privacy requirements.
The User accepts, declares, and undertakes that in case personal data belonging to third parties is found in links saved within the Mobile Application, their titles, descriptions, and parameters, they are obligated to act in compliance with the law regarding the processing of personal data, have made necessary notifications to the relevant persons, and have fulfilled consent obligations where necessary. The User is obligated to respect the rights of third-party data subjects within the scope of the Mobile Application’s use.
4.7. Age Requirements and Children’s Use
The Mobile Application has not been developed for frequent use by children or directly targeted at children. We care about protecting children’s privacy and personal data. The Mobile Application should not be used without parental control.
5- Responsibility Regarding Third-Party Service Providers
We use the infrastructure, services, and offerings of third-party service providers within the Mobile Application in order to provide you with the Mobile Application and carry out our activities.
Advertisements belonging to third parties (within the scope of Google AdMob usage) may be displayed within the Mobile Application.
Services provided and activities carried out by third parties are subject to their own terms, conditions, and policies. The User acknowledges being informed of this matter, that Pushit is not responsible for third-party services outside its control, and that the terms and conditions of the relevant parties will apply. Pushit is not responsible for services provided and transactions carried out by third parties, and does not make any express or implied commitment or warranty regarding such services.
6- In-App Purchases and Payments
PushIt may offer the Mobile Application with different usage options. In free usage, ad display and certain usage limits may apply, while additional features may be available through In-App Purchase.
If in-app purchases are involved, these transactions are carried out through the App Store and Google Play platforms based on data you personally provide to the relevant platform, and the respective platforms’ own policies and conditions will apply regarding payments. No payment transaction is carried out on Pushit’s side.
7- Intellectual Property Rights
The software, codes, methods, interface, texts, logos, graphics, and all intellectual property rights on the Mobile Application belong to Pushit.
Regarding open-source software or other third-party software embedded or integrated within the Mobile Application, license rights and conditions are subject to the license terms of the relevant third parties.
The User may only use the Mobile Application individually within the specified purpose and acceptable usage limits. The Mobile Application may not be used outside these limits, for commercial purposes, or in a manner that would cause infringement of intellectual property rights.
Processing or modifying the Mobile Application or third-party software integrated into it, or engaging in any activity that could constitute infringement of intellectual property rights, is prohibited. Without limitation, use for different purposes, modification, reproduction, copying, uses contrary to the Terms and Conditions, and other such actions constitute copyright infringement.
The User will respect the intellectual property rights of third parties regarding links saved within the Mobile Application and will not carry out any transaction that could cause infringement of intellectual property rights.
The User is exclusively responsible for any damages to Pushit or third parties arising from their transactions and activities causing infringement of intellectual and industrial property rights.
8- Disclaimer of Liability
Pushit does not make any express or implied commitment or warranty that the Mobile Application will operate without errors or interruptions, regarding its performance, that it will meet User expectations or needs, fitness for a particular purpose, or any other matter.
The Mobile Application is provided “as is.” Pushit may update the Mobile Application, perform maintenance, introduce additional features or modules, temporarily or permanently remove it, or close access without providing any reason or notice. The User continues to use the version updated by Pushit. No claim, commitment, or warranty is made that previous versions and the current version will be compatible or will operate without errors or interruptions.
Pushit is not responsible for any direct or indirect damages from links, categories, tags, and any other content saved by the User to the Mobile Application, or from illegalities or problems arising from use.
Regarding third-party websites, mobile applications, platforms, and content to which User-saved links redirect, including but not limited to their reliability, legal compliance, currency, accuracy, and accessibility, these are outside Pushit’s control and no claim, commitment, or warranty is made in this regard.
Regarding third-party software and services utilized within the Mobile Application, terms and conditions, license terms, and related matters are subject to the relevant third parties’ license conditions, and no commitment or warranty is made regarding services provided by third parties.
Pushit is not responsible for any direct or indirect damages arising from illegalities, errors, problems, or incompatibilities originating from Users or third parties.
Pushit bears no direct or indirect responsibility for damages that rights holders or third parties may suffer due to Users’ behavior contrary to law and the Terms and Conditions. The sole addressee for complaints, requests, and applications from third parties or authorized institutions is the User.
Without limitation, Pushit is not responsible for any problems or direct or indirect damages arising from software and platforms outside its control, force majeure events, User hardware or operating system issues, internet connection errors, service providers, third-party software, third-party websites, mobile applications, content, connection errors, malfunctions, losses, technical problems, or any issues arising from third parties or users.
9- Termination and Account Deletion
In case of termination of the Terms and Conditions, you will not be able to access or use the Mobile Application.
In case of User behavior that violates or threatens to violate the law, legislation, Terms and Conditions, or third-party rights, Pushit has the right to immediately suspend the User’s use of the Mobile Application temporarily or permanently, suspend access, or close the account without any notice. In such cases, the User will have no claims against Pushit.
The User can delete their account through the “Delete My Account” option, in which case all data will be destroyed in compliance with legislation.
10- Validity of Records, Disputes, and Applicable Law
The User accepts, declares, and undertakes that data maintained by Pushit within the scope of the Mobile Application’s use constitutes evidence.
In case of any dispute regarding these Terms and Conditions, Turkish Law shall apply. Istanbul Central Courts and Enforcement Offices shall have jurisdiction in resolving disputes arising from the application of the Terms and Conditions.
11- Effectiveness and Changes
Terms and Conditions may be changed or updated unilaterally by us. In such cases, the relevant documents will be updated accordingly on the Mobile Application and the website (https://pushit.tech).
The User is responsible for following updated versions of the Terms and Conditions. Updates and changes will be effective from the moment they are published. Users who wish to continue using the Mobile Application accept to act in compliance with changes and updates.
